Terms of Service

These Terms govern your access to and use of the Settle platform, websites, and services operated by Settle Technologies, Inc. (“Settle,” “we,” “us”). By creating an account or using Settle, you agree to these Terms. If you do not agree, do not use the service.

1. What Settle is — and isn’t

Settle is a software platform and a settlement network that helps consumers prepare, send, and resolve offers on their own unsecured debts, and helps creditors and debt-resolution firms receive and respond to those offers. Settle is not a lender, creditor, debt collector, debt-settlement or debt-relief company, credit-repair organization, law firm, money transmitter, or tax advisor. Settle does not act as your agent, negotiate on your behalf, or make decisions for you. You authorize every communication and make every accept, counter, or reject decision yourself.

2. Eligibility & accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. Notify us promptly of any unauthorized use.

3. Consumer use

You decide which debts to act on and what offers to make; Settle prepares and routes them at your direction. Settlement outcomes are not guaranteed — a creditor may accept, counter, or decline. Resolving a debt for less than the balance owed may have tax and credit consequences. Nothing in the service is legal, financial, or tax advice; consult a qualified professional about your situation. Availability varies by state.

4. Partner use (creditors, DR firms, partners)

If you access Settle as a creditor, debt-resolution firm, or other partner, your organization’s use is also governed by the agreement executed with Settle, which controls in the event of a conflict. You are responsible for your authorized users, for using the network in compliance with applicable law (including FDCPA/Reg F, TSR, FCRA, and TCPA as applicable to you), and for the accuracy of the data you submit. An offer is an offer — Settle does not filter, favor, or pick accounts on your behalf.

You consent to transact electronically. Your electronic signatures and authorizations are legally binding under the E-SIGN Act and UETA, and are sealed into a tamper-evident record.

7. Acceptable use

Do not misuse the service: no unlawful, fraudulent, or infringing activity; no attempting to access data you’re not authorized to; no interfering with the platform’s security or operation; no submitting information you don’t have the right to submit.

8. Intellectual property

Settle and its licensors own the platform, software, and content. We grant you a limited, revocable, non-transferable license to use the service for its intended purpose. You retain your own data; you grant us the rights needed to operate the service for you.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant any particular settlement outcome, credit result, or uninterrupted operation.

10. Limitation of liability

To the maximum extent permitted by law, Settle is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability for any claim is limited to the amounts you paid Settle in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify Settle against claims arising from your misuse of the service, your violation of these Terms, or your violation of law or the rights of others.

12. Dispute resolution & governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved as set out here and in any applicable arbitration agreement provided at signup; where arbitration applies, you may have the right to opt out as described there. Nothing limits rights that cannot be waived under applicable law.

13. Changes & termination

We may update these Terms; we’ll revise the “last updated” date and, for material changes, provide notice. Continued use after an update means you accept it. You may stop using the service at any time; we may suspend or terminate access for violations of these Terms or as required by law.
